By accessing or using PassportPhoto.help ("the Service," "we," "our," or "us") at www.passportphoto.help, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Service

PassportPhoto.help is an online passport and ID photo maker that provides the following services:

  • AI-powered passport and ID photo creation and processing
  • Automatic background removal and replacement
  • Photo cropping and resizing to comply with official requirements for passports, visas, and ID documents from multiple countries
  • Print-ready photo layout generation (multiple photos on one sheet)
  • Digital download of processed photos in JPEG, PNG, or other formats
  • Compliance checking against biometric photo standards

Important: PassportPhoto.help is a photo preparation tool. We do not guarantee acceptance of photos by any government agency, embassy, or official authority. Users are responsible for verifying that their photos meet the specific requirements of the issuing authority.

3. User Accounts

3.1 Account Creation

You may use certain features without an account. To access full features, you must create an account by:

  • Signing in with your Google account via Google OAuth 2.0, or
  • Registering with your email address and password

You must be at least 13 years old to create an account. By creating an account, you represent that the information you provide is accurate and complete.

3.2 Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately at [email protected] if you suspect unauthorized access
  • You must not share your account with others or allow others to access your account

3.3 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, if you violate these Terms or engage in fraudulent, abusive, or illegal activities. You may also delete your account at any time by contacting us.

4. User Content and Acceptable Use

4.1 Photo Ownership

You retain full ownership of all photos you upload. By uploading a photo, you grant us a temporary, limited license to process and store it solely for the purpose of providing the Service. All uploaded photos are automatically and permanently deleted within 24 hours.

4.2 Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

  • Upload photos of individuals without their consent
  • Upload photos containing illegal, harmful, obscene, or offensive content
  • Upload photos that infringe on the intellectual property or privacy rights of others
  • Attempt to manipulate photos to fraudulently misrepresent a person's identity on official documents
  • Use the Service to distribute malware, viruses, or other harmful code
  • Attempt to gain unauthorized access to our systems, servers, or databases
  • Use automated bots, scrapers, or tools to abuse the Service
  • Resell, sublicense, or redistribute our services or processed photos commercially without our written permission
  • Circumvent any usage limits or technical restrictions

Note on photo fraud: Using passport or ID photos that do not accurately represent the subject to obtain official documents is illegal in most jurisdictions. We reserve the right to report suspected fraudulent use to appropriate authorities.

5. Pro Subscription

5.1 Subscription Plans

We offer Pro subscription plans that unlock enhanced features, including but not limited to:

  • Unlimited photo downloads without watermarks
  • Access to all country/document photo specifications
  • Higher resolution output options
  • Priority processing

5.2 Payment

  • All payments are processed securely by Stripe, a PCI DSS-compliant payment processor
  • We accept major credit cards and other payment methods supported by Stripe
  • Subscription fees are billed in advance on a monthly or annual basis
  • All prices are displayed in USD unless otherwise stated
  • Prices may change with at least 30 days' prior notice to active subscribers

5.3 Refunds and Cancellation

You may cancel your Pro subscription at any time. Your subscription benefits will remain active until the end of the current billing period, after which no further charges will be made.

Subscription fees are generally non-refundable except:

  • Where required by applicable consumer protection law
  • If the Service experienced significant downtime or technical failures during the billing period
  • At our sole discretion for exceptional circumstances

6. Free User Limitations

Free (non-subscribed) users are subject to usage limitations, which may include:

  • A limited number of photo downloads per day
  • Watermarks applied to downloaded photos
  • Restricted access to certain photo specifications or output formats
  • Lower resolution output options

7. Intellectual Property

All content, features, and functionality of the Service — including but not limited to the website design, text, graphics, logos, algorithms, and software — are owned by PassportPhoto.help or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works of any part of the Service without our prior written consent.

8. Privacy and Data Protection

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

Key points regarding your data:

  • Uploaded photos are automatically deleted within 24 hours
  • We use Google OAuth, Stripe, and Resend as trusted service providers
  • We do not sell your personal information to third parties

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted, timely, secure, or error-free
  • Processed photos will be accepted by any government agency or official authority
  • Results obtained from using the Service will meet your specific requirements
  • The Service will be free from viruses or other harmful components

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PASSPORTPHOTO.HELP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or data
  • Rejection of official documents or applications due to photo non-compliance
  • Costs of obtaining alternative services
  • Any other indirect or consequential losses

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $10 USD, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless PassportPhoto.help and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service in violation of these Terms
  • Your violation of any applicable law or third-party rights
  • Any content you upload or submit through the Service

12. Third-Party Links and Services

The Service may contain links to third-party websites or services. These links are provided for your convenience only. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. We encourage you to review the privacy policy and terms of any third-party site you visit.

13. Changes to Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide notice by posting the updated Terms on our website with a new "Last Updated" date, and by email notification to registered users where required. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. You agree to submit to the personal jurisdiction of the courts competent to hear such disputes.

15. Dispute Resolution

We encourage you to contact us first to resolve any disputes informally at [email protected]. If informal resolution is not possible, any disputes arising out of or related to these Terms or the Service shall be resolved through binding arbitration, except where prohibited by applicable law. Nothing in this section shall prevent either party from seeking injunctive or other equitable relief.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
